It's not a good time to be Steve Madden. Alexander McQueen, creator of the much buzzed-about Faithful bootie, is suing Madden for selling what, according to McQueen's lawyers, is nearly a direct copy. McQueen's attorneys told WWD: "In fact, the only design element of the ‘Faithful Bootie’ that Madden did not deliberately copy is the zipper pull that contains the ‘Alexander McQueen’ trademark."
We have to say, the Madden version - the Seryna bootie - does look pretty similar to the original style, released in January and photographed on the likes of Rihanna and Mary-Kate Olsen. A lawsuit filed on Oct. 1 calls the Madden version a "studied imitation" designed to cash in on the "widespread media attention" to McQueen's shoe.
McQueen's lawyers said they issued a cease and desist letter to Madden last month but it was ignored. Now, the attorneys are seeking an injuction prohibiting Madden from selling products that infringe on its "trade dress" and asking for profits plus interest from wrongful acts. They also have requested that the goods in question be delivered so they can be destroyed and that the Madden corporation cover necessary legal fees and relief.

In some unfortunate news, it's been confirmed that Yohji Yamamoto has officially filed for bankruptcy In Japan as a result of being approximately $76 million in debt.
According to The Cut, his situation isn't too bad though. An investor has offered a substantial amount to help with management and allow the brand to operate business as usual.

In the current economic slump, it looks like emerging designers aren't the only ones going down the diffusion line route to produce clothes that people can actually afford.
Badgley Mischka is the latest big brand to follow the trend. The Home Shopping Network, who have been desperately been trying to get a piece of the fshion pie, have signed the design duo up to produce an affordable line with them. The new move for the network was hardly a suprise. Recently, CEO Mindy Grossman told WWD: "We weren’t the most fashionable and we had to really define this.”
The line, called American Glamour which is set for release next month, will include shoes and accessories as well as apparel.
